Protect Your Estate and Its Assets With Proper Planning

Estate planning is a crucial process that lays out the details of future management and distribution of your assets, finances, and medical care. An estate plan includes documents such as wills, trusts (revocable and irrevocable), powers of attorney and advanced medical directives.

Creating a comprehensive estate plan can help you avoid unnecessary time within the probate court, unnecessary large estate taxes and may even completely remove your estate from the probate process all together. A carefully crafted estate plan will stipulates what assets are passed along to your family, friends, and organizations.

While it is never too late to start, it is recommended that you draft your estate planning documents when you are in good physical or mental health.  Early planning will prevent many of the questions regarding your capacity.  Additionally, putting your wishes in writing will help prevent unnecessary confusion or arguments within your family.

Early planning is even more important with a "Blended" family.  Did you know that Indiana law limits the amount a subsequent spouse without children can take from your estate?  For example, if you married your spouse (who had prior children) and have you had no children with your spouse prior to their death, most of your spouse's individual assets will pass directly to his/her children and relatives and not to you, their spouse?  No-one wants this!

If you need any help in creating, reviewing, or interpreting your will or trust, you can contact us at Nickloy, Albright, Gordon, & Siebe Attorneys At Law LLC. We will assist our clients to identify their assets, select the roles individuals will play after death, and provide important information for the family when the time comes.
